The Esports Club(TEC) is a platform with the sole aim of powering esports experiences.

ACCEPTANCE OF TERMS:

By accessing or using The Esports Club (TEC), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

ELIGIBILITY:

To use the Service, you must be at least 12 years old. By using the Service, you represent and warrant that you are of legal age to form a binding contract with TEC.

ACCOUNT REGISTRATION:

  • Provide accurate, current, and complete information during the registration process.
  • Update your information to keep it  accurate and current.

To access certain features of the Service, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account information and all activities that occur under your account. You agree to:

  • Violates any laws or regulations.
  • Infringes on copyrights, trademarks, privacy rights, or any other third-party rights.

TEC reserves the right to remove or moderate any User Content that violates these terms.

You are solely responsible for any content you submit, post, or display on the Service, including text, images, videos, and other media. You agree not to upload, post, or transmit content that:

  • Violates any laws or regulations.
  • Infringes on copyrights, trademarks, privacy rights, or any other third-party rights.
  • Contains harmful, offensive, or misleading information.
TEC reserves the right to remove or moderate any User Content that violates these terms.

PROHIBITED CONDUCT:

  • Use the Service for any unlawful or unauthorized purpose.
  • Attempt to gain unauthorized access to TEC systems or user accounts.
  • Interfere with or disrupt the Service or its connected servers.
  • Engage in any form of harassment, hate speech, or abusive behavior.
  • Use cheats, hacks, or unauthorized third-party software to gain an unfair advantage in TEC games.
  • Impersonate any person or entity or falsely claim an affiliation with TEC.
  • Violate any applicable laws or regulations.

You agree not to:

  • Use the Service for any unlawful or unauthorized purpose.
  • Attempt to gain unauthorized access to TEC systems or user accounts.
  • Interfere with or disrupt the Service or its connected servers.
  • Engage in any form of harassment, hate speech, or abusive behavior.
  • Use cheats, hacks, or unauthorized third-party software to gain an unfair advantage in TEC games.
  • Impersonate any person or entity or falsely claim an affiliation with TEC.
  • Violate any applicable laws or regulations.

TERMINATION:

TEC reserves the right to suspend or terminate your account and access to the Service at its sole discretion and without prior notice, including but not limited to cases where you violate these Terms of Service.

CHANGES TO TERMS:

TEC may update these Terms of Service from time to time. Any changes will be effective upon posting on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the updated terms.

LIMITATION OF LIABILITY

  • Loss of profits, revenue, data, use, goodwill, or other intangible losses.

TEC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

TDS DEDUCTION POLICY

  1. Applicability of TDS on Prize Money
    • TDS (Tax Deducted at Source) is applicable on all prize money payouts, irrespective of the amount won.
    • This is in accordance with the Income Tax Act, 1961, specifically:
    • Section 194B – for winnings from games, quizzes, lotteries, etc.
    • Section 194BA – applicable to winnings from online games, which mandates TDS without any threshold.
    • TEC applies a flat TDS rate of 31.2% (inclusive of surcharge and cess) on the gross prize money earned.
  2. Threshold Exemptions Not Applicable
    • Participants should note that no minimum threshold exemption applies, even if the prize money is less than ₹10,000.
    • This is due to the mandatory nature of Section 194BA, and to ensure consistency in tax compliance across all prize disbursals.
    • TDS is deducted on each prize transaction individually, not cumulatively.
  3. Consent for TDS Deduction
    • By agreeing to these Terms and Conditions, the participant explicitly consents to the deduction of TDS by TEC on any prize money won.
    • This consent applies to all current and future tournaments organized by Basik Marketing Private Limited under the TEC brand.
  4. TDS Deposits and Form 26AS Credit
    • The deducted TDS amount will be deposited with the Government of India within the timelines prescribed under applicable tax laws.
    • The same will be reflected in the participant's Form 26AS, accessible through their PAN account, after the relevant quarterly TDS return is filed and processed by the Income Tax Department.
    • Participants must ensure that they provide a valid and accurate PAN number to avoid any issues with credit of TDS.
  5. No Responsibility for Individual Tax Positions
    • Basik Marketing Private Limited will not be responsible for:
    • A participant's individual tax liability or filing obligations.
    • Refund expectations or claims related to excess tax deductions.
    • Delays or errors in TDS credit due to incorrect or missing PAN details provided by the participant.
    • Participants are encouraged to consult a qualified Chartered Accountant or tax advisor for guidance on their personal tax matters.
  6. Non-Acceptance of Terms
    • If a participant does not agree with this TDS policy, they are advised not to register for or participate in any TEC tournament.
    • By proceeding with registration and accepting prize money, the participant automatically consents to these terms and waives any right to dispute the tax deduction at a later date.

By registering for and participating in any tournament, competition, or contest organized by The Esports Club (TEC), operated by Basik Marketing Private Limited, each participant acknowledges, accepts, and agrees to the following tax-related terms:

GOVERNING LAW:

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of India.
